These Terms of Service ("Terms") are a binding agreement between you and Budget Book ("Budget Book," "we," "us," or "our") governing your use of the Budget Book application and website at https://budget-book-ten.vercel.app/ (the "Service"). By creating an account, clicking "I agree," or using the Service, you accept these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. The Service is not directed to children under 13, and we do not knowingly collect information from them.
Budget Book is a personal finance tracking tool that lets you record and organize budgeting information you enter yourself. Budget Book is an organizational tool only. It does not provide financial, investment, tax, accounting, or legal advice (see Section 7).
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly at yourbudgetbook@gmail.com of any unauthorized use. We are not liable for losses arising from unauthorized access caused by your failure to safeguard your credentials.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service, other accounts, or our systems; (c) interfere with or disrupt the Service; (d) reverse engineer, scrape, or copy the Service except as permitted by law; (e) upload malicious code; or (f) impersonate any person or entity. We may suspend or terminate accounts that violate this section.
You retain ownership of the financial information and other content you enter into the Service ("User Data"). You grant us a limited license to host, store, process, and display your User Data solely to operate and improve the Service. Our collection and handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
You are solely responsible for the accuracy of the User Data you enter. We recommend you keep independent records of important financial information.
The Service is provided for informational and organizational purposes only. Nothing in the Service constitutes financial, investment, tax, accounting, or legal advice, and no fiduciary or advisory relationship is created by your use of the Service. Any calculations, summaries, charts, or categorizations generated by the Service are based solely on data you provide and may contain errors. You are solely responsible for your financial decisions. Before making financial decisions, consult a qualified professional, such as a licensed financial advisor, accountant, or attorney. See also our Disclaimer.
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or free of data loss, or that any calculations or outputs will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by law, in no event will Budget Book, its owner(s), affiliates, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, savings, or financial opportunity, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Budget Book and its owner(s) from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your User Data, your use of the Service, or your violation of these Terms or applicable law.
Please read this section carefully — it affects your legal rights.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring an individual claim in small claims court or seek injunctive relief for intellectual property violations.
Class Action Waiver: You and Budget Book agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
You may opt out of this arbitration agreement by emailing yourbudgetbook@gmail.com within 30 days of first accepting these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. Upon termination, Sections 6–11 and 13–15 survive. You may request export or deletion of your data as described in the Privacy Policy.
We may modify or discontinue the Service at any time. We may update these Terms from time to time; if we make material changes, we will provide notice by email or in-app notice and update the "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Subject to Section 11, any claims not subject to arbitration must be brought in the state or federal courts located in Middlesex County, Massachusetts.
These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
